PUBLIC CONTRACT (OFFER)
for ordering, purchase and sale, and delivery of goods
Under this Contract, the Seller, Individual Entrepreneur "Karchenkov Pavlo Andriiovych", on the one hand, and any person who has accepted the terms of this public offer contract — the Buyer, on the other hand, hereinafter collectively referred to as the Parties, have entered into this Public Contract for the sale and purchase of goods (hereinafter referred to as the "Contract" or the "Public Contract"), addressed to an unlimited number of persons.
This Contract is an official public offer of the Seller to enter into a contract for the sale and purchase of Goods with Buyers, photographs of which are posted on the website: https://www.stijoy.com and in the "Stijoy" application.
1. General Provisions
1.1. Contractual relations between the Seller and the Buyer are formalized in the form of a public offer contract. Clicking the "Cart" button signifies full acceptance of the terms of this Contract.
1.2. This public offer contract is public in accordance with Articles 633 and 641 of the Civil Code of Ukraine.
1.3. The terms of this Contract are the same for all Buyers.
1.4. The Contract comes into force from the moment the "Cart" button is clicked and remains valid until the Parties have fully fulfilled their obligations.
1.5. Acceptance of the offer means unconditional acceptance of all terms of this Contract.
2. Terms and Definitions
2.1. Public Offer — a public proposal by the Seller to conclude a contract for the sale and purchase of goods by remote means.
2.2. Goods — the subject of the transaction selected by the Buyer in the mobile application.
2.3. Online Store — the Seller’s mobile application.
2.4. Buyer — a legally capable natural person or legal entity.
2.5. Seller — Individual Entrepreneur "Strochyk Yevhen Oleksandrovych", identification code 3680006976.
3. Subject of the Contract
3.1. The Seller undertakes to transfer the Goods into the ownership of the Buyer, and the Buyer undertakes to pay for and accept them.
3.2. Ownership rights pass at the moment the Goods are handed over.
3.3. The Seller has the right to amend this Contract unilaterally.
4. Ordering Goods
4.1. The Buyer independently places an Order in the Online Store.
4.2. Clicking the "Place Order" button signifies full acceptance of the terms of this Contract.
4.3. The Order processing period is up to 7 business days.
4.4. The Seller has the right to reject an Order if the Goods are unavailable.
5. Rights and Obligations of the Parties
5.1. The Buyer is obliged to provide accurate information and pay for the Goods.
5.2. The Seller is obliged to provide accurate information about the Goods.
6. Price and Payment
6.1. The price of the Goods is indicated in the national currency of Ukraine.
6.2. Payment is made using one of the available payment methods.
7. Delivery of Goods
7.1. Delivery is carried out using the selected method.
7.2. The risk of loss passes to the Buyer at the moment the Goods are received.
8. Returns of Goods
8.1. Returns are carried out in accordance with the Law of Ukraine "On Consumer Protection".
9. Liability of the Parties
9.1. The Parties shall bear liability in accordance with the legislation of Ukraine.
10. Force Majeure
10.1. The Parties shall be released from liability in the event of force majeure circumstances.
11. Other Terms
11.1. This Contract is governed by the legislation of Ukraine.
